May I simply use lemon laws and consumer protection statutes instead of automobile warranties?

Published by admin under General Articles

You may use any of these options. But note that there are differences among these laws, and that they may provide for different kinds of remedies. If you are in the position of taking legal action against a seller, consult a lawyer about what options you have under federal and state law.
If you can prove that the seller engaged in fraud or deception, you may be able to take advantage of your state’s laws concerning unfair or deceptive acts and practices. If the car truly is a lemon, you may have options under your state’s lemon law. Keep all of your papers concerning the car, including records and receipts.

May I get my money back if I reject a car after purchase or revoke acceptance?

Published by admin under General Articles

You should be able to recover your money. If your written demand for a car refund is denied, you will have to sue the seller. The seller has the right to deduct an amount per mile driven from your refund. If your rejection is found to be wrongful, the seller may recover damages against you.
